Toxic Tort Expert Testimony and Environmental / Occupational Health Assessment: Sick Buildings, Indoor-Outdoor Air, Drinking Water, Landfills, Hazardous Materials
TOXIC AGENT EXPERIENCE:
SHORT BIOGRAPHY: Dr. Wayne Roth-Nelson, MSTM, (Environmental Health, The American University, 1974); PhD (Environmental Science and Policy, The London School of Economics, 1986); DABFE (Diplomate, American Board of Forensic Examiners, Toxicology Division, 1996-2009); FACFEI (Fellow, Institute of Forensic Science, American College of Forensic Examiners, 2006-2009). FORENSIC SCIENCE CAREER. Past 15 years' experience as toxic tort scientific consultant and expert witness for plaintiff and defense counsel in fields of environmental health and occupational health. Developed and presented quantitative evidence of toxic exposure, absorbed dose, and health risk or disease causation. Contaminated media include sick buildings, indoor and outdoor air, ground and surface water, soils and landfills, aquifers and drinking water, and hazardous waste. Disciplines include environmental toxicology and epidemiology, air and water quality, hydrology and hydrogeology, and soil science. Provided testimony by deposition and in state and federal trial courts. Half of 54 cases involved Sick Buildings with workers, shoppers and residents exposed to molds and bacteria, paint and metal fumes, solvent and fuel vapors, and combustion gases. Four cases (Florida, Missouri, New Mexico, Wyoming) involved large industrial or agricultural operations affecting entire communities (aerial pesticide spraying of citrus groves, ball bearing manufacturing, ethanol production from corn, an abandoned petroleum refinery). Founder and first elected chair of Risk Science & Law Specialty Group, Society for Risk Analysis. Bringing together scientists and lawyers to evaluate policy on regulating public health risks from exposures to toxic substances in the environment is the main activity. The interfacing legal practices and scientific findings that support toxic tort litigation are examined, among other activities. Served as editor, peer reviewer, and author of online and journal publications, many dealing with both science and law. A popular law journal article, "Risk Evidence in Toxic Torts," is cited by the American Bar Association, Harvard Law School, and the Florida Supreme Court.
R & D SCIENCE CAREER. Over three decades consulting in the R & D community in the environmental health sciences, health risk assessment, hazardous waste management, and regulatory compliance. Organizations included Westinghouse Urban Systems, GE TEMPO/Center for Advanced Studies, TRW/DeLeuw Cather, Dynamac/Enviro Control, Battelle Memorial Institute, and Science Applications International Corporation (SAIC). Assignments included Manager, Health Risk Assessment/Deputy Program Manager at Battelle Institute; also Technical Director/Program Manager at SAIC's Environmental Remediation Division. Client organizations included Congressional Office of Technology Assessment, Environmental Protection Agency, Air Force Occupational and Environmental Health Laboratories, Energy Department Environmental Restoration Division, and Interior Department Office of Biological Services.
